DELHI, NY – Acting District Attorney Shawn Smith announced today that Luke Lupo, 45, of Walton, New York, appeared in Delaware County Court on November 13, 2023, and pleaded guilty to Burglary in the Third Degree, a Class D Felony.
Lupo appeared before the Honorable Gary A. Rosa, Acting Delaware County Court Judge, on Monday November 13th to be arraigned on a Superior Court Information charging him with Burglary in the Third Degree. After being arraigned, the defendant pleaded guilty to the charge.
Prior to pleading guilty, the defendant admitted that in April of 2022, he entered a building owned by Herman’s Trailer Sales and Service, in the Town of Walton, and stole property.
This guilty plea was entered pursuant to a negotiated disposition whereby it is expected that the defendant will be sentenced to 5 years of felony probation supervision and ordered to pay restitution to the victim. The Court ordered a Pre-Sentence Investigation, and sentencing was scheduled for January 16, 2024
